The law requires that insurance companies treat you fairly. Sometimes they do not. The Massachusetts Consumer Protection Act, General Laws chapter 93A, provides us with a very powerful tool for holding them accountable for their unfair practices. It allows us to sue for your damages and make the insurance company pay our fees and all the costs of the litigation. And if the judge finds that the unfair practice was a “willful or knowing” or a “bad faith” violation, the court may award up to triple your actual damages as a penalty.
General Laws chapter 176D sets out a long list of rights and protections you have against bad faith insurance practices, but these laws also have specific detailed procedural requirements that must be followed, or you may lose a valid claim. For example, a Demand Letter must be sent 30 days prior to filing suit. It must meet certain legal requirements. The Demand Letter will almost always be challenged as insufficient, and you need an experienced lawyer to figure out how to respond when that happens.
